Driver’s license and state ID in Idaho
- Update your name
- YesAfter your legal name change
- Gender markerThe sex or gender field (M, F, or X) printed on an ID document or stored in an agency's record.
- LimitedM or F with an amended birth certificate
For most people, you can no longer change the sex on an Idaho driver's license or ID. The Transportation Department ties the marker to your birth certificate, and Idaho stopped amending the sex on birth certificates in January 2026. You can still change your name on the card in person with a certified court order, after updating Social Security.

How it works
Until mid-2024, the Idaho Transportation Department (ITD) let people change the sex on a license or ID with form ITD 3533. That form was withdrawn around July 1, 2024, when HB 421 took effect. That law (Idaho Code § 73-114) defines "sex" in all Idaho laws, rules, and policies as biological sex.
Since then, ITD reportedly changes the marker only with an amended birth certificate. Idaho itself stopped amending the sex on birth certificates when a federal court dissolved the F.V. v. Barron injunction on January 8, 2026. So if you were born in Idaho and did not already have an amended certificate, there is now no way to change the marker. Only M and F exist on Idaho cards.
If you already have an amended birth certificate (from Idaho before 2026, or from a state that still amends them), ask your county DMV office whether ITD will accept it. We could not confirm this in writing.
Name changes are still available. Update Social Security first, then go to a county DMV office with a certified copy of your court order.
Steps
Update your name with Social Security first[6]
ITD verifies your Social Security record electronically and will not change your name until SSA has the new name.
Bring a certified copy of your name change order, your current license or ID, proof of identity and lawful presence, and proof of Idaho residency. Driver's license offices are run by county sheriffs. A new photo is taken.
Bring the certified amended birth certificate to the county office, or call the ITD Customer Contact Center at 208-584-4343 first to ask whether it will be accepted. There is no published form or written policy.
