How it works
SB 2322 (2026) amended Miss. Code § 63-1-35. Any new, renewal, or duplicate driver's license, temporary permit, or commercial driver's license must "bear a designation of the sex of the individual which shall be consistent with the sex of the individual determined at birth." Changes are allowed only to fix a clerical error, a documented difference of sex development, or to reverse a license that was earlier "voluntarily altered" to a different sex.
This means that if your license was updated before July 2026, the Department of Public Safety (DPS) can change it back when you renew or replace it. Before 2026, DPS had no written policy; some people updated their marker with an amended birth certificate and court order.
Only M and F are printed. Name changes still work normally.
Steps
Get your certified name change order[6]
DPS accepts only a marriage license, divorce decree, adoption order, or court order to change the name on a license or ID. See the name change guide.
Update Social Security first[7]
DPS checks your name against Social Security records, so update SSA first and wait a day or two.
Bring the certified court order, your current license, your birth certificate, proof of your Social Security number, and two proofs of Mississippi address. You will take a new photo. DPS recommends making an appointment. The duplicate fee is $11.

After you finishIf your license cannot match your gender, a U.S.
If your license cannot match your gender, a U.S. passport or passport card is the main alternative ID, but federal policy on passport sex markers has also changed; check the current rules before applying. Keep a copy of your court order with you when your ID and presentation differ.
Tips1 tip from people who have done this
- If your license already shows your correct gender, renewing or replacing it may trigger a change back to your sex at birth under SB 2322. Talk to the ACLU of Mississippi before renewing if this worries you.
