How it works

Form MVD-10237, Request for Sex Designation Change, lets you pick Male (M), Female (F), or X. You swear, under penalty of perjury, that the request is so your license or ID "accurately reflects my sex identity" and is not for a fraudulent purpose, and you sign in front of a notary. Nothing else is required for the sex field. The same form works for a first New Mexico license or ID when you want a different marker from your other documents.

Changing your name is a separate requirement: bring the original or certified court order (or marriage certificate or divorce decree) showing the new name. You can do both on the same visit.

Steps

  1. Fill out MVD-10237 and sign it before a notary[1]

Download the form, fill in your information, choose M, F, or X, and sign it in front of a notary public. No medical or court document is needed for the sex field.

  2. If your name is changing, bring proof[1]

Bring the original or a certified copy of your court order (or marriage certificate or divorce decree) showing your new legal name. Update Social Security first, since the MVD checks your name against it.

  3. Visit an MVD office[4][5]

Make an appointment through MVD's online scheduling if your office offers it. Bring your current license or ID, the notarized MVD-10237, and any name-change documents. Expect a new photo and a fee for the amended card.

Other
An older MVD procedures manual section (2019) ties the X marker to a New Mexico birth certificate showing X. The current form offers X by self-attestation; if an office asks for a birth certificate, show them form MVD-10237.
How long it takes

One office visit. You may receive a temporary paper credential while the new card is mailed.

If you chose X or changed your marker, be aware that the US passport and Social Security record currently cannot show X or a changed sex marker. Your New Mexico card remains valid ID. If you were born in New Mexico, you can also update your birth certificate by self-attestation (see the birth certificate guide).

Tips2 tips from people who have done this
  • Bring the form unsigned if you are not sure a notary will be available; signing ahead of time without a notary makes the form invalid.
  • TGRCNM in Albuquerque helps people with ID document changes and can answer questions about what the MVD is accepting in practice.
