Oklahoma does not change the sex marker on a driver's license or state ID, and does not offer X. Under a 2023 executive order and a 2024 law, the marker must reflect sex at birth. You can still update your name in person at a Service Oklahoma office or Licensed Operator with a certified court order, for $25.

How it works
Oklahoma used to allow sex marker changes on licenses. On August 1, 2023, Governor Kevin Stitt signed Executive Order 2023-20, which defines "sex" as biological sex at birth for state agencies. Service Oklahoma (which took over licensing from the Department of Public Safety) stopped issuing marker changes. In 2024 the Legislature wrote the same definition into law (HB 1449, the "Women's Bill of Rights", 25 O.S. § 16, effective November 1, 2024). No doctor's letter, court order, or amended birth certificate will change the result, and there is no X option.
If your license already shows a changed marker, the order does not require you to turn it in, and no law penalizes you for carrying it. It is unclear whether Service Oklahoma will keep the changed marker when you renew or replace the card. If you face a problem, contact ACLU of Oklahoma or A4TE (contacts below).
Your name can still be changed on the card. State law requires you to apply for a replacement within 10 days of a legal name change.
Steps
Update your name with Social Security first[2]
A4TE advises changing your name with the Social Security Administration before going to Service Oklahoma, so the records match.
Bring your current license or ID, a certified copy of your name change order (originals or certified copies only; notarized copies are not accepted), and, if you are getting a REAL ID, proof of identity, Social Security number, and two proofs of Oklahoma residency. Check Service Oklahoma's documents list before you go.
Name changes cannot be done online. Make an appointment or walk in at a Service Oklahoma licensing office or a private Licensed Operator (tag agency). Pay the replacement fee and take a new photo. Do this within 10 days of your name change.
Costs and fee waivers
No fee waiver is available for this step.[7]
There is no general low-income waiver. Replacement ID cards are free for people 65 and older, and state law exempts verified homeless youth under 18 from ID card fees.

RequirementsWhere you live, timeline
- Where you live
- You must hold or be applying for an Oklahoma driver's license or identification card.[5][8][9][3][1][2]
- Other
- For a name update you need a certified copy of each legal name change document (court order, marriage certificate, or divorce decree) linking the name on your identity document to your current name.
- How long it takes
One visit. You leave with a temporary credential; the card arrives by mail.
After you finishYour license will show your new name but the sex marker from your birth record.
Your license will show your new name but the sex marker from your birth record. The US passport also cannot currently show a changed sex marker under federal policy, so for now every Oklahoma-issued and federal ID will likely show the same marker. If a license with a previously changed marker is revoked or not renewed, contact ACLU of Oklahoma (intake@acluok.org) and A4TE.
Tips1 tip from people who have done this
- Carry your certified name change order the first time you use the new card for anything important, in case records have not caught up.
