How it works

Birth certificates for people born in Guam are kept by the Office of Vital Statistics (OVS) of the Department of Public Health and Social Services (DPHSS).

  • Sex marker: under 10 GCA § 3222(e), OVS amends the sex only when you submit a written request plus a sworn statement from the physician who performed the surgery, certifying that your sex has been changed by surgical procedure. No court order is needed, but hormone therapy alone or a letter from a doctor who did not perform surgery does not qualify under the statute. There is no X option.
  • Name: under § 3222(c), OVS amends the name when you give it a certified copy of your Guam court order changing your name.
  • Amended certificates are marked "Amended," and the date and evidence are noted on the record (§ 3222(b)). Certified copies of amended records show that they were amended (§ 3226).

If you were born elsewhere, the rules of your birth state or country apply.

Steps

  1. For a name change, get your court order first[1]

Finish your Superior Court name change (see the Guam name change guide) and get a certified copy of the order. Guam law requires the order to be filed with OVS within 30 days.

  2. For a sex marker change, get a sworn statement from your surgeon[1]

Ask the physician who performed your surgery for a sworn (notarized) statement certifying that your sex has been changed by surgical procedure. Include your full name as it appears on the birth certificate and your date of birth.

  3. Contact the Office of Vital Statistics[3][2]

Call OVS at (671) 300-9263, 9264, 9265, or 9270 to confirm the current fee, the forms, and whether you can apply by mail. Then submit your written request, the supporting document (certified court order or surgeon's statement), and a photo ID.

  4. Order certified copies[3]

Since June 2026 OVS has limited certified copies to one per event because of a shortage of security paper. Ask whether the limit is still in effect.

More detail

After you finishWith an amended Guam birth certificate you can update your Guam driver's license or ID.

With an amended Guam birth certificate you can update your Guam driver's license or ID. For your passport and Social Security record, see the federal guides. Their sex fields are currently frozen, but the name can be updated.

Tips1 tip from people who have done this
  • If you had surgery years ago, the statement must still come from the surgeon who performed it. If that surgeon is unavailable, ask OVS in writing what it will accept, and consider talking to a lawyer.
